10.     Order No. 06100-1230 – re: reappointment of Lynn Faust to the Community Development Authority, term to expire 2009. Recommendation of Committee was 3-0 to refer back to the Mayor.

11.     Order No. 06100-1330 – re: reappointment of Linda Creamer, Craig Hunt, terms exp. May 1, 2009 (David Gadbois, term exp. May 1, 2011), to the Recreation Commission,  Recommendation of Committee was 3-0 to approve Creamer/Hunt only.

12.     Order No. 06100-1331 – re: appointment of Michele Higgins to the Conservation Commission . Recommendation of Committee was 2-0 to approve. (Councilor Clancy abstained)

13.     Order No. 06100-1334 – re: appointments of John Peltier, Kevin Boyle to replace Stanley Supeck as Fence Viewers terms to expire Feb. 2008. Recommendation of Committee was to approve 3-0.

14.     Order No. 06100-1315 – re: appointments or Victor Berch,term to exp. 08, Carol Henderson, term to exp. 09, Alfred Hill, term to exp. 08, Debra McManus, term to exp. 07, Beatrice Morris, term to exp. 07, Anne Ryan, term to exp. 09, John Usinas, term to exp. 08, Pat Winske, term to exp. 09, to the Commission on Disabilities. Recommendation of Committee to approve 2-0 (Councilor Towle abstained).

From the Legislative and Legal Affairs Committee
15.     Order No. 06100-1337 – re: Municipal Aggregation.
1) Accept the City of  CityplaceMarlborough “Aggregation Plan” (Community Choice Power Supply) as amended by the DTE.  Recommendation of Committee 2-0.
2) Accept all three “Competitive Electric Supply Agreements” from Con Ed Solutions, Direct Energy and Dominion Retail as amended. Recommendation of Committee 2-0.
3) They also recommended that the initial contract would be limited to a 12 month maximum term. Recommendation of Committee 2-0.
4) Requirement that the R-1 (residential) class rate be lower that the prevailing National Grid Basic Service Rate. Recommendation of Committee 2-0.
5) The recommendation that the Council pass an order allowing the Mayor to have exclusive authority to execute a binding agreement with the selected supplier once pricing bids had been received and reviewed and would have the authority to amend the ESAs with regard to non-substantive issues same to the Council., was reported out without a recommendation, It was felt by the Committee that the Council might have other ideas as to the exclusive authority for signing the contract before an order was introduced . Recommendation of Committee 2-0.  Place on the agenda November 6, 2006 meeting.
