25. Order No. 04-100398 - re: amend Special Act to increase membership of CDA from five to seven persons and if approved; one of the additional members be a licensed real estate broker and one a banker, both being either resident of Marlborough or individual doing business in Marlborough and a member of the Marlborough business community. Recommendation of Committee to approve as amended 3-0.
26. Order No. 04-100377 - re: amend Code, add to Art. II, Sec. 63 Plumbing Permits, add new Section re: plumbing and gas fitting permits and amend C.147 re: penalties and enforcement. Recommendation of Committee to APPROVE subject to amendment that "Sec. 63.11(B) shall read: Permits to perform plumbing work shall be issued to licensed plumbers only. Permits to perform gas fitting work shall be issued to licensed plumbers or licensed gas fitters only 3-0.
27. Order No. 04-100312 re: Special Permit, The Richmond Co., drive-through window at proposed Walgreens, 529 Boston Post Rd and 788 Farm Rd. Recommendation of Committee to approve Findings and Conditions as amended (Petitioner to finalize with Solicitor's Office and to include following condition re: mitigation: "Prior to issuance of a Building Permit, Applicant shall pay the sum of seventy-five thousand ($75,000.00) dollars to an account appropriately designated by the City Treasurer with the approval of the City Council to provide off-site mitigation to deal with various public safety, aesthetic and other off-site impacts of the project 5-0 (amended condition by Atty. Bergeron: Finding of Fact #3 "A walk-up ATM is also proposed for the site. This use allowed as of right, however, the proposed location of the walk-up ATM is less than fifty (50) feet from the proper line such that the Application was required to seek a variance from the ZBA as set forth in Paragraph 4 below".
